Terms and Conditions (T&C) of the Performance Coach

Kaufland.de offers sellers the opportunity to book an additional service in the form of the "Performance Coach".

Services of Kaufland.de

(1) The inclusive services of the Service listed below are a service package. The individual service elements and related activities are only provided as a whole and can only be used in total. They are always valid for the service period of six months. The following service elements are included in the "Performance Coach" service package:

a. Introductory Call

i. Description: The purpose of the Introductory Call is for you and the Performance Coach to get to know each other, for you to ask your first questions and to share your goals and intentions in order to best prepare the following Coaching Calls. If you renew your membership for another six months, the Introductory Call will turn into a regular Coaching Call. Our goal is to always provide you with one contact person. There is no entitlement to the assignment of a specific coach.

ii. Procedure: Once you have received confirmation of your registration from us, you can choose a date for your Introductory Call. The appointment will take place via video conference through a link provided by Kaufland.de.

iii. Duration: The duration of the Introductory Call is 45 minutes.

iv. Non-attendance of a Call: Should you not be able to attend your Introductory Call, you have the option of canceling it at least 24 hours before the start of the call and making an alternative appointment. Should you fail to meet this deadline, your right to this call will be cancelled. A replacement appointment will then be deducted from your Coaching Call contingent, so that you can subsequently arrange only two instead of three individual Coaching Calls without additional payment. Since the Introductory Call is a fundamental prerequisite for the following Coaching Calls, it cannot be skipped.

b. 3 individual Coaching Calls

i. Description: The topics of the calls will be individually designed according to your needs. Possible topics are: Performance and sales increases, product data optimizations, Google Shopping, marketing measures and many more. Please note that this contract is a service contract and not a contract for work, meaning for example that a specific increase in sales is not the subject of the contractually owed service.

ii. Procedure: Once you have completed your introductory/Coaching Call, you can choose an appointment for your (next) Coaching Call until your contingent of included calls is exhausted. The appointment will take place via video conference through a link provided by Kaufland.de.

iii. Duration: The duration of the Coaching Calls is 30 minutes each.

iv. Non-attendance of a Call: Should you not be able to attend your Coaching Call, you have the option of canceling it at least 24 hours before the start of the call and making an alternative appointment. Should you fail to meet this deadline, your right to this call will be cancelled. A replacement appointment will then be deducted from your Coaching Call contingent.

c. Premium Phone Support

i. Description: The Premium Phone Support is an exclusive service offered only to Performance Coach users. Thanks to the prioritized handling of your concerns by our qualified staff, you save time and can focus on what's important - your customers. The call-back service included in Premium Phone Support ensures that your questions are answered promptly.

ii. Procedure: As a Performance Coach user, you will receive the Phone Number of the Premium Phone Support. Here you can call at any time and as often as you like within business hours.

d. Free SPA Budget

i. Description: In addition to the support from your personal performance coach, you receive credit for placing Sponsored Product Ads (SPA) in the amount of 30 euros per month. With this credit, you can further increase the visibility of your offers.

ii. Procedure: Every full month you will receive a credit of 30 Euros to place SPA. This credit is a discount that is always deducted from the net amount at the end of the month and credited to your SPA bill. Any excess credit expires at the end of the month and cannot be transferred in the next month or paid out. To ensure that you can fully utilize this credit, this will be available to you starting the following month after you register for the Performance Coach. For example, if you are registered on July 14, you will receive your SPA credit for six months starting August 1.

e. Weekly Reports

i. Description: As a Performance Coach user, you benefit from additional reports: these are provided to you on a weekly basis by e-mail and contain important information on your performance as well as on numerous development topics.

ii. Procedure: You will automatically receive an email with your report attached every Monday. Various KPIs are listed here, which are updated on a weekly basis. You will receive the first report about one week after registering for the Performance Coach.

(2) In addition to the three included Coaching Calls, you can book an additional Coaching Call at any time at an additional cost of 39 euros net plus VAT. You can add as many Coaching Calls as you wish within the term of your contract. Please contact your Performance Coach on this matter.

(3) You will receive a feedback request from us at regular intervals and after each Coaching Call. This feedback is used to adapt the services of the performance coach and the Coaching Calls even better to your needs.

Duration, Termination and Contractual Partner

The contract has a duration of six months from the day on which you receive the registration confirmation from us. The contract can be terminated by either party with four weeks' notice to the end of the six months. Each of the parties reserves the right to terminate the contract for extraordinary reasons.

If the contract is not terminated in due time, it shall be automatically extended by another six months. Notice of termination must be given in writing. After termination in a timely and formal manner and expiration of the contractual duration, any claim to unused inclusive services of the Performance Coach Service shall be voided.

Furthermore, the contract ends automatically with the termination of the seller's activity on Kaufland.de. Contractual partner is the Kaufland e-commerce GmbH, Location: Stiftsbergstraße 1, 74172 Neckarsulm.

Compensation & Payment

The compensation is 249 euros net, plus the legally owed VAT per month.

The payment is automatically charged to your Kaufland.de credit and appears as a separate item on your monthly commission invoices. The debit takes place from the following month after registration. If you have registered within the last three working days before the end of the respective month, the first debit will take place the month after next.

For example, if you are registered on July 14, the first debit will be in August. If you cancel your contract in due time, your membership will expire on January 14 of the following year. The last billing will then take place in January.

In case of dissent the German version shall prevail.
